These Terms of Service ("Terms") govern your use of the mobile game LumiBurst (the "Game"), provided by ByteString Games Studio ("we", "us"). By downloading or playing the Game, you agree to these Terms. If you do not agree, do not use the Game.
01 License
We grant you a personal, non-exclusive, non-transferable, revocable license to install and play the Game for your own non-commercial entertainment, subject to these Terms.
02 Acceptable use
You agree not to:
- Reverse engineer, decompile, or modify the Game except where permitted by law
- Cheat, exploit bugs, or use unauthorized third-party software to gain an advantage or disrupt other players
- Attempt to interfere with, overload, or gain unauthorized access to our systems or the services the Game relies on
03 Virtual items and in-app purchases
- The Game offers virtual items (such as pearls and a "Remove Ads" unlock) that can be bought with real money through Google Play.
- Virtual items have no real-world monetary value, cannot be exchanged for cash, and are licensed to you, not sold.
- All purchases are processed by Google Play and are subject to Google's terms. Refunds are handled according to Google Play's refund policy; we do not process payments directly.
- The "Remove Ads" purchase is a one-time purchase that removes ads for the account/device that bought it. It is restored automatically on reinstall or a new device via your store account.
- We may add, change, or discontinue virtual items or their prices.
04 Advertising
The Game is supported by advertising. By playing the free version, you agree to view ads. You may remove ads through the in-app purchase described above.
05 Availability and changes
We may update, change, suspend, or discontinue the Game or any feature at any time, and we may update the Game for compatibility, security, or improvements. We are not liable for any modification, suspension, or discontinuation.
06 Disclaimers
The Game is provided "as is" and "as available" without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the Game will be uninterrupted, error-free, or free of harmful components.
07 Limitation of liability
To the fullest extent permitted by law, ByteString Games Studio will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, progress, or virtual items, arising from your use of the Game. Where liability cannot be excluded, it is limited to the amount you paid us (if any) in the twelve months before the claim.
08 Termination
We may suspend or terminate your access to the Game if you violate these Terms. You may stop using the Game at any time by uninstalling it.
09 Governing law
These Terms are governed by the laws of Illinois, USA, without regard to conflict-of-law rules.
10 Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above.
